A. General

1. G.R.Y.N Generators Ltd. (hereinafter: “G.R.Y.N Generators”) is a company engaged in the import and marketing of, inter alia, electrical and lighting materials and accessories (hereinafter: the “Products”).
2. G.R.Y.N Generators has established a website intended for e-commerce for the purchase of products, as they appear in the relevant product catalog at the time of making the purchase (the supply and quantity of products in the catalog are subject to change at the sole discretion of the website operator) and subject to these Terms of Use (hereinafter: the “Website”).
3. The use of the Website in all its content and services is offered to the user and/or the user thereof (hereinafter: the “User” or the “Purchaser”) subject to acceptance of all the terms and conditions contained in the Terms of Use as they are today and/or as amended in the future.
4. Browsing the Website and/or registering to receive its services will be considered as agreement by the User to these Terms. If you do not agree to them, refrain from using this Website. Using the Website and/or providing any information for publication on the Website and reading notices published on it, attest to agreement to all terms of use as detailed in these Terms of Use.
5. 12. Some of the products offered for purchase on the Website are accompanied by a warranty certificate. In these cases, a warranty certificate will be issued by the manufacturer and/or importer and/or service provider (hereinafter: “the Responsible Holder”).
13. The sole responsibility for the products, their quality, their quality, their durability, their ability to operate properly and the specifications of their activity applies only to the person responsible and not to G.R.Y.N Generators.
14. Every purchaser declares by the very act of making the purchase that the content of this section has been brought to his attention and that he will have no claim and/or demand and/or claim against G.R.Y.N Generators and/or anyone on its behalf, as well as against the site operators and/or anyone on their behalf in connection with the above features, but only to the responsible holder. c. Placing an order

15. User/Purchaser – If you wish to purchase a product(s), please register on the website and leave identification details: name, address, email address, phone number, login username. Password will be returned to the email address that was entered. In order for the order to be executed quickly and without any problems, it is necessary to provide the correct details, otherwise G.R.Y.N Generators will not be able to guarantee the execution of the order. Filling in the details is a condition for making the purchase.
16. In order to order a product through the website, you must first choose a product that can be purchased through the website using the link “Add to Cart”.
17. It is possible to order a product with the addition of shipping fees for delivery to the customer’s home, subject to the provisions of these regulations.
18. In addition, the customer will be able to order a product by self-collection while specifying the branch from which the customer wishes to collect the ordered product.
19. At the checkout you are asked to register your credit card details as well as the number of payments, according to the practice of G.R.Y.N Generators, and confirm the transaction.
20. Immediately after the operation is performed, G.R.Y.N Generators will check the credit card details and upon confirmation of the order by the credit card companies, an appropriate notification will be given on the computer screen that the order has been confirmed and a confirmation and a purchase invoice will be sent to the email address of the transaction.
21. In the event that the order is not approved by the credit card company, the user will receive an appropriate notification from the order center. If the credit card company’s confirmation is not received on time, the transaction will be valid and the order will be null and void.
22. It should be clarified and emphasized that the order will be considered complete only after receiving confirmation from the credit card company, and G.R.Y.N Generators is not obligated to the user as long as the order has not been approved by the credit company.
23. The registration recorded in the G.R.Y.N Generator computers and the confirmation of the payment by the credit card company will be evidence of the correctness of the actions.
24. Registration on the site constitutes the user’s confirmation to be included in the list of G.R.Y.N Generators customers, which are part of the distribution of G.R.Y.N Generators’ direct mailing, unless the user indicates during the purchase that he is not interested in doing so.

D. How to Perform a Purchase Transaction

25. G.R.Y.N Generators and/or the Site Operators will not be responsible for a mistake in executing the purchase transaction resulting from the insertion of incorrect details or any details by the Purchaser into the System. However, to the extent that the Site Operators are aware of the incorrect detail that has been entered, it will be corrected by them.
26. The delivery of the product will be done to the address that will be entered by the purchaser into the system, and to it only.
27. It is clarified beyond any doubt that in any case in which a product appears without a price or at a price of 0 NIS, it will not be possible to purchase the product and the order line of this product if it is ordered will be canceled without any demand for compensation or indemnification by the orderer.
28. The details of the purchase transaction and the details of the purchaser will be used for the internal use of G.R.Y.N Generators only and will not be transferred by G.R.Y.N Generators to any other party, except for transferring the details to the credit card company in order to receive approval to execute the purchase transaction. The purchaser agrees that G.R.Y.N Generators will store his details in its data system.

Payment

29. The purchaser will be charged for the product he purchased using the credit card immediately upon placing the order to purchase the product, and subject to the approval of the credit card company.
30. When purchasing a product in installments, in accordance with the payment terms detailed on the website, the purchaser will be charged using the credit card, subject to the approval of the credit card company, by way of debiting his account once a month in accordance with the payment mechanism as agreed.
31. All prices displayed on the G.R.Y.N Generators website include VAT. The prices do not include transportation and installation expenses, as well as any additional or other expenses that will apply to the purchaser.
32. It is clarified that the prices of the products displayed on the Website, which are binding on the Purchaser, may differ from the prices displayed in G.R.Y.N Generator Stores, and the Purchaser hereby irrevoriably waives any claim and/or demand regarding non-conformity, if and to the extent that there is any.

and. Supply/Transportation of Products

33. G.R.Y.N Generators will provide every product purchased on the website to the address in Israel typed at the time of purchase, within 21 business days from the date of ordering the product, unless otherwise stated on the website.
34. G.R.Y.N Generators will not be responsible for any delay or delay in the supply and/or failure of supply caused by force majeure and/or events beyond the control of G.R.Y.N Generators, including strikes, Saturdays, etc.
35. In areas that are limited to access from a security point of view, G.R.Y.N Generators will be allowed to place the products for the buyer in an acceptable nearby place, which will be coordinated with him in advance.
36. The price of transportation or delivery is correct for the G.R.Y.N Line only, with the exception of the Dead Sea and Eilat areas. G.R.Y.N Generators will be entitled to condition the supply of the product to the aforementioned areas on payment of a different transportation price
37. The delivery fees detailed on the website do not include irregular transportation and/or delivery outside of Israel. Irregular transportation means transportation to high floors with no possibility of transportation by elevator and/or transportation that requires additional manpower and/or special means. In the absence of an elevator, deliveries will be delivered to the customer only up to the entrance to the building, and the courier will not bring the products up to the apartment.
38. In the event of irregular transportation and/or delivery outside of Israel, G.R.Y.N Generators will be entitled to charge an additional fee on top of the fee charged for regular transportation.
39. When supplying the product, G.R.Y.N Generators is entitled to demand the presence of the credit card holder when delivering the product, and/or to present the credit card holder’s ID card and/or the credit cardholder’s signature on a voucher as a condition for delivering the product.
40. It should be clarified that the shipping fees may differ from product to product and will be determined at the sole discretion of G.R.Y.N Generators according to their weight.
41. The purchase invoice of the product will be inserted into the outer carton in which the purchased product is packaged.

G. Cancellation of the Transaction

42. The purchaser has the right under Section 14C (c)(1) of the Consumer Protection Law, 5741 – 1981 (hereinafter: the “Consumer Protection Law”), to cancel the purchase transaction in writing by written notice to the G.R.Y.N Generator offices within fourteen days from the date the purchaser received the product or from the date the purchaser received a document containing the details included in section 14 c (b) of the Consumer Protection Law, whichever is later.
43. In any case of a purchaser’s request to cancel the transaction after the product has already been shipped, the purchaser must return the product at his own expense to the extent possible or reasonable in its original packaging, and to the extent possible or reasonable, complete and without damage, damage, defect or malfunction of any kind to any of the G.R.Y.N Generators branches.
44. The results of the cancellation of the transaction will be in accordance with the provisions of Section 14 of the Consumer Protection Law.
45. It should be emphasized that in accordance with these provisions, the purchaser is obligated to return the product to G.R.Y.N Generators branches, and he must return the product independently to one of its branches. If the buyer requests that G.R.Y.N Generators transport the returned product to one of its branches, whether the product has reached him or the product is on its way to him, the purchaser will bear the cost of transporting the product as aforesaid, according to the transportation costs accepted by G.R.Y.N Generators.
46. If for any reason the buyer is not satisfied with the product he purchased, the product can be returned in accordance with Regulation 2(1) of the Consumer Protection Regulations (Cancellation of Transaction) 59”a – 2010 up to two weeks from the date of purchase. All this, together with a receipt or invoice and its original packaging, provided that it has not been used. G.R.Y.N Generators undertakes to credit the buyer’s credit card, after receiving confirmation from the branch to which the product was returned, provided that the product was returned in full in its original packaging.
47. In any case of a request to cancel a transaction after the product has already been shipped (except in the case that the product is defective), the purchaser must return the product in its original packaging, complete and/or without damage and/or damage and/or defect and/or spoilage and/or use of any kind or type, to one of the G.R.Y.N Generator branches at his own expense.
48. As a rule, a product whose packaging has been damaged, or a product that has been broken or spoiled as a result of improper use or a consumable product, in addition there is no replacement/return of a product that has been cut or adjusted to size.
49. In accordance with the provisions of the Consumer Protection Law, if a consumer chooses to cancel the transaction, G.R.Y.N Generators is entitled to charge a cancellation fee of up to 5% of the price of the purchased product or NIS 100, whichever is lower.
50. In addition, in the event of cancellation of such transaction, if the value of the product has decreased due to a significant deterioration in its condition, G.R.Y.N Generators is entitled to claim its damages from the purchaser.
51. Cancellation of a purchase transaction that is not in accordance with these conditions will have no validity.

H. Delivery of Electronic Waste

52. Dear customer, you can deliver to us, at any of the branches of the chain, waste electrical and electronic equipment similar to the item(s) sold to you, in accordance with the provisions of the law.

I. Law and Place of Jurisdiction

53. The use of the Service and the Information shall be governed solely by the laws of the State of Israel, and the sole and exclusive place of jurisdiction for any matter deriving from the Service and Information and their use and the Website shall be in the competent courts in Tel Aviv only.
